Fences Brochure

The City of Miramichi and non-incorporated areas in the Miramichi Planning District regulate the height of fences as well as construction materials used in order to enhance aesthetic appearance, promote traffic visibility, assure public security and facilitate snow clearing operations.

This series of brochures presents the most important aspects to consider before undertaking any development in the Miramichi Planning District. Where there is conflict between this brochure and the existing legislation, the latter prevails.

Permit Required

The construction or installation of a fence requires a building and/or development permit from the Commission.

Fences can be used to: protect privacy, enhance the aesthetic quality of a property, reduce unauthorized access, hide unpleasant views and uses, deaden noise, deflect snow, and surround playing fields, swimming pools, artificial ponds, quarries and animal enclosures.

Construction Materials

Fences shall be built with galvanized (or other CSA approved coating) chain link, wood or other suitable material, and they shall not be electrified or incorporate barbed wire or other dangerous materials. Fences cannot encroach on street right-of-ways and it is recommended that they be situated on the property line with the mutual consent of both property owners or inside the property lines.

Location

Whoever contemplates erecting a fence on a property line should meet with the adjacent neighbor to confirm the boundary location and to agree on the type of construction. If any doubt exists concerning the location of a boundary, landowners can apply to the Registrar General of Land Titles to have the location of the boundary confirmed under the Boundaries Confirmation Act.

Maximum Fence Height

Front Yard - 1 meter (except for security fence in commercial, industrial and community use zone)

Residential Zones - 2 meters

All Other Zones - 2.5 meters
