Subdivision Approvals
Subdividing Your Land Brochure A subdivision is dividing a property into two or more parcels of land or lots and may also imply the creation of public or future streets and private accesses. A person seeking approval of a subdivision shall submit copies of a tentative subdivision plan and a written application to the Planning Commission. When tentative approval is given, final subdivision plans must be prepared by a licensed N.B. Land Surveyor.
Steps To Follow 1.
Prior
to contacting a surveyor, you should meet with the Planning Commission's
Development Officer. He or she will advise you as to any possible problems
with your project, offer alternative solutions and inform you of expected
procedures. 2.
When creating a public street, a future street, or a private access, the
plan must be approved by the Municipal Council if your subdivision is in the
municipality, or the Department of Transportation if it is located in
an unincorporated area. 3.
The Development Officer will review your plan and submit copies to all
government agencies involved; ex: transportation, municipal departments, NB
Power, NB Tel, etc. The applicant must submit a copy of the plan directly
to the Department of Health and Wellness and pay applicable fee. 4.
If the plan involves the laying out of public streets, private accesses,
land for public purposes or requires a variance from the Subdivision By-Law or
regulation, the tentative plan will require approval or recommendation form the
Planning Commission. 5.
When creating a public street, a future street, or a private access, the
plan must be approved by the Municipal Council if your subdivision is in the
municipality, or the Department of Transportation if it is located in an
unincorporated area. 6.
The final subdivision plan is prepared and the construction of any
street(s) as well as the installation of any required services must be completed
before it is submitted to the Development Officer, along with any required fee,
for final approval. 7.
Your final plan should now be filed at the County Registry Office within
six months of the final approval. The appropriate deeds for the sale of
each lot may then be prepared.
You may now prepare a tentative subdivision plan to be submitted to the Planning Commission's office for review. |
